Is it legal to run an SMM panel?
The short answer depends on where you are and what you sell. The questions every panel owner should think through — and when to ask a lawyer.
This is one of the most common questions from new panel owners. There's no single answer for every country, but there are clear questions to work through. This article is general information, not legal advice.
Running an online business
Selling digital marketing services online is a normal business activity in most places. The usual rules apply: register your business where required, pay the relevant taxes, and keep records of your income.
Platform terms are a separate question
Social networks' terms of service generally prohibit artificially inflating engagement. Breaking a platform's terms is usually a contract matter between the account holder and the platform rather than a crime — but it can lead to removed engagement, reduced reach or suspended accounts. Be honest with customers about these risks.
Consumer protection
Describe services accurately, publish your refund and refill policies, and honour them. Misleading customers is where real legal trouble usually starts.
Payments and data
- Payment providers have their own acceptable-use rules; read them before you rely on one.
- You hold customers' personal data. Protect it, collect only what you need, and follow the privacy laws that apply to your customers.
What you should never sell
Anything involving hacked accounts, stolen data, impersonation or harassment is illegal and has nothing to do with running a legitimate panel.
When to talk to a professional
If you're scaling up, operating across several countries or unsure about tax registration, a short consultation with a local lawyer or accountant is money well spent.
